1: General provisions
The e-commerce website of Enhance by Maria Fenlon with its registered office at 4 Adelaide house, 7/8 Haddington Terrace, Dublin, Dublin, A96 XC99, Ireland, provides its customers with the option of buying products from its webshop.

These General Terms and Conditions (“Terms”) are applicable to all orders placed by a visitor to this e-commerce website (“Customer”). When placing an order via the webshop of Maria Fenlon Interiors Ltd., Customer must explicitly accept these Terms, whereby Customer agrees to the applicability of these Terms with the exclusion of all other conditions. Additional Customer conditions are excluded, except when explicitly accepted beforehand in writing by Maria Fenlon Interiors Ltd.

2: Price
All prices listed are expressed in EUR.

For EU countries all prices displayed are inclusive of VAT (value added tax). All non-EU countries are shipped on a DDU (delivery duty unpaid) basis and all product prices displayed are exclusive of all taxes and duties. The user from a non-EU country is liable for all import duties, customs, and local sales taxes levied by the destination country.

3: Availability
The product selection is valid while stocks last and may at any time be changed or withdrawn by Maria Fenlon Interiors Ltd. Maria Fenlon Interiors Ltd. cannot be held liable for the non-availability of a product. If an offer is for a limited duration or subject to conditions, this will be stated in the offer.

4: Ordering and Payment Terms
When an order is placed the binding sales agreement between the Customer and Maria Fenlon Interiors Ltd. is reached when the Customer receives an order confirmation email in which the availability and estimated delivery time are confirmed.

Unless otherwise agreed by the Maria Fenlon Interiors Ltd., payment must be received by the Customer prior to delivery of an order.

Maria Fenlon Interiors Ltd. reserves the right to reject any order in its sole discretion.

Credit Card
Maria Fenlon Interiors Ltd. accepts the following credit cards: Visa and MasterCard. Your credit card details will not be stored in our database. In order to process your payment as safely as possible, Maria Fenlon Interiors Ltd. collaborates with Shopify payments, powered by Stripe, a company that meets the highest safety standards.

PayPal

You only need your email address and PayPal password. Please visit the PayPal website for more information. Payment by PayPal is always free of charge.


5: Delivery and execution of the agreement
Delivery charges vary depending on the shipping destination and are stated for each order at check-out.

Delivery times vary from product to product. Delivery time is determined by the availability of the product and order destination.

Maria Fenlon Interiors Ltd. shall not be liable for delays in performing or failure to perform this Agreement or any obligations hereunder, which are directly attributable to causes beyond its reasonable control (force majeure), including, but not limited to, acts of God, fires, strikes, labor disputes, war, acts or intervention by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.

Maria Fenlon Interiors Ltd. reserves the right to deliver different products ordered at the same time separately.

Maria Fenlon Interiors Ltd. takes responsibility for the loss and damage of the product up to the time of delivery.

The risk due to loss or damage is transferred to the Customer at the time the goods have been physically received by the Customer (or a third party indicated by the Customer that is not the carrier).  However, the risk transfers to the Customer upon delivery to the carrier if the carrier was contracted to transport the goods by the Customer instead of contracted by Maria Fenlon Interiors Ltd.

6: Retention of title
Delivered articles remain the exclusive property of Maria Fenlon Interiors Ltd. until the moment the Customer pays for the goods in full.
If necessary, the Customer undertakes to inform third parties of the retention of title belonging to Maria Fenlon Interiors Ltd., e.g. to anyone who would attempt to seize articles that are not fully paid for.

7: Right of withdrawal (Returns/Refunds)

Cancellation and returns

If your online purchase is delivered and you find that is not exactly what you wanted or you have simply changed your mind, then the EU Consumer Rights Directive provides a 14-day cooling off period starting from the date you received the item.

The customer has a right to return a product if:

● The order has been cancelled according to the terms and conditions by notifying Maria Fenlon Interiors Ltd. within 14 days of delivery,
● The product has not been used.
● The product is in the condition that the customer received it in and all the parts of the product are included in the package.
● The product has been repackaged into its original package or an equivalent.
● The product must be returned immediately after cancellation.
● When returning products Customers will be responsible for the risk of damages.
● Customers are responsible for postage to return items.

If the terms of the return have been met, we will replace the product or issue a refund to the original payment method.  
Please contact us beforehand at enhance@mariafenlon.com if you wish to return a product. You will need to specify the order number, the items/quantities that you wish to return and a statement or complaint. We will then forward you the return address.

10: Use of cookies

11: Invalidation - non-relinquishment
If any provision of these Terms is declared invalid, illegal or void, it shall in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Maria Fenlon Interiors Ltd. to enforce any of the rights set out in these Terms, or to exercise any equivalent right, shall never be deemed as a waiver of such provisions and will never invalidate these rights.

12: Amendments to the Terms
These Terms may be amended or supplemented by and at the sole discretion of Maria Fenlon Interiors Ltd. by other terms and conditions when introduced by it.  In the event of inconsistencies these Terms shall take precedence. 

13: Proof
The Customer accepts that electronic communications and backups shall serve as furnishing of proof.

14: Applicable law - jurisdiction
These Terms and any agreement or contract arising therefrom shall be governed and construed in accordance with the laws of the Republic of Ireland. Any dispute, controversy, claim, complaint or action arising therefrom shall be subject to the jurisdiction of the Irish Courts.

15: Limitation of liability
The information contained on the website is of a general nature. This information does not relate to personal or specific circumstances and cannot, therefore, be considered as personal, professional or legal advice to the user.
Maria Fenlon Interiors Ltd. makes every effort to ensure the information provided is complete, correct, accurate and up to date. Despite these efforts, the information provided may contain errors. If the information provided contains errors, or if specific information is unavailable on or via the website, Maria Fenlon Interiors Ltd. will make every possible effort to rectify this as soon as possible. However, Maria Fenlon Interiors Ltd. cannot be held liable for direct or indirect damage resulting from the use of the information on this website. The total aggregate liability of Maria Fenlon Interiors Ltd. for any and all claims arising out of the product(s) sold or services supplied under these Terms and any contract or agreement arising therefrom shall be limited to the price paid by the Customer for the product(s) the subject of the confirmation order.

While every effort has been made to portray items accurately, slight variations may occur.

All measurements quoted are approximate and the reproduction of colours is as accurate as photographic and publishing processes will allow.

Please note there may be variations in colours dependant on the calibration and settings of individual screens.

Natural fibres, dye lots & wood finishes can vary from batch to batch, therefore, we recommend ordering multiples at the same time to ensure production will be from the same batch.
